Effective Date: January 31, 2026
- Definitions
- “Company,” “We,” “Us,” “Our”: Haslet Poop Scoop LLC.
- “Customer,” “You,” “Your”: The individual or entity receiving the service.
- “Service”: Dog waste removal and related services provided by Haslet Poop Scoop LLC.
- “Subscription”: The recurring monthly payment plan for ongoing services, calculated on a 52-week average.
- “Initial Clean” / “One-Time Clean”: A non-recurring or first-time service visit to remove accumulated waste.
- “Agreement”: These Terms & Conditions.
- Service Structure & Pricing Model
Subscription Customers (Recurring):
- Flat Monthly Rate: Your monthly fee is calculated by taking the annual value of 52 weeks of service and dividing it into 12 equal monthly payments.
- Billing Consistency: You will be charged the same amount on the 1st of every month. This rate remains the same regardless of whether the month has 4 or 5 weeks.
- Pre-Pay Policy: Service is billed in advance. Payment processed on the 1st covers service for that month.
One-Time & Initial Cleanings:
- Hourly Billing & Minimum: One-time and Initial cleans are billed on an hourly basis. A Minimum Service Feeapplies to all such visits, which covers the first hour of labor. This minimum fee is charged in full regardless of whether the service takes the full hour or less.
- Extended Time: Any labor exceeding the first hour is billed at the Company’s current hourly rate.
- Payment Due: A valid card must be on file, and payment is processed upon completion of the visit.
- Estimates: Quotes provided for one-time cleans are estimates based on typical conditions. If a yard has excessive waste accumulation requiring significantly more time than estimated, the final invoice will reflect the actual time spent on site.
- Access, Safety & Gate Liability (CRITICAL)
Customer Responsibility:
- Gate Access: You must provide accurate gate codes or unlocked access on your service day.
- Pet Containment: To ensure the safety of our technicians and prevent pets from slipping out of the gate, we require pets to be secured indoors during the service visit.
- Exceptions (Pets in Yard): If you choose to leave pets in the yard, you do so at your sole risk. We reserve the right to skip service (charged as “Attempted”) if a technician feels unsafe or if the dogs interfere with the work.
- Gate Latch Verification: The Customer agrees to inspect all gates and latches prior to releasing pets into the yard after every service visit.
Release of Liability (Gate & Escapes): Haslet Poop Scoop LLC is not liable for lost pets, bites, or injuries resulting from pets being left in the yard during service. You assume full responsibility for any escapes that occur while the technician is entering or exiting the property.
- Waste Removal Limitations & Health
- Tall Grass: We cannot guarantee waste removal if grass exceeds 6 inches. We will scoop what is visible, but we are not liable for missed waste in overgrown yards.
- Old/Disintegrated Waste (Initial Cleans): For initial cleanups of neglected yards, we cannot remove waste that has dissolved into the soil or turned into “mud.” We guarantee the removal of all visible, firm waste.
- Waste Condition: We remove solid waste only. We cannot scoop diarrhea, loose stool, or waste that has disintegrated due to weather/age.
- Pet Health (Biohazard): To protect our staff and other clients’ dogs, we reserve the right to skip service if we observe signs of contagious illness (e.g., worms, Parvo). You must notify us immediately if your dog is diagnosed with a contagious parasite.
- Proof of Service
To ensure transparency and prevent fraud, Haslet Poop Scoop LLC documents visits. Any of the following shall constitute conclusive Proof of Service:
- GPS-verified dashcam footage showing arrival at the property.
- GPS timestamps from our routing software.
- A photo of the closed gate upon departure.
- Technician service logs.
- Chargeback Policy: Filing a chargeback for a service that was completed (or validly attempted) according to these terms is considered a breach of contract. We reserve the right to use dashcam footage and service logs to dispute any illegitimate chargebacks.
- Satisfaction Guarantee
We strive for excellence. If you are dissatisfied with a service:
- Notification Window: You must notify us within 24 hours of the visit.
- Remedy: We will return to re-clean the area at no additional cost.
- Acceptance: Failure to report issues within 24 hours constitutes acceptance of the completed service.
- No Refunds: We offer re-cleans to correct issues, but we do not offer money-back refunds once service (or attempted service) has been performed.
- Cancellations, Pauses & Skips
- Cancellation: You may cancel your subscription at any time via the client portal. Services already paid for in the current month will continue until the month ends; no partial refunds are issued.
- Skip Requests: If you need to skip a visit (e.g., vacation), please notify us 24 hours in advance. For subscription clients, approved skips may be issued as a credit toward the next billing cycle at the Company’s discretion.
- Inaccessible Yards: If we cannot access your yard (locked gate, blocked entry, aggressive dog), the visit is considered “Completed” and no credit or refund will be issued.
- Inclement Weather Policy
We work in rain and cold, but not in dangerous conditions (lightning, ice, flooding).
- Weather Delays: If weather prevents service, we will attempt to service the yard later in the week.
- Missed Weeks: If a week is entirely missed due to extreme weather (“Acts of God”), service will resume the following week. No refunds are issued for weather interruptions, as the subscription covers the cumulative maintenance of the yard over the year.
- Billing & Late Payments
- Automatic Payments: By enrolling, you authorize Haslet Poop Scoop LLC to charge your card on file automatically on the 1st of each month (or upon completion for one-time services).
- Declined Cards: If payment fails, service will be paused immediately. A late fee of $10 may be applied if the balance is not resolved within 5 days.
- Collections: Accounts overdue by more than 30 days may be sent to third-party collections.
- Marketing & Media Release
The Customer grants Haslet Poop Scoop LLC permission to use photos or video of the Customer’s yard and pets for social media, advertising, and training purposes. The Company agrees that no private identifying information (such as house numbers, street names, or family surnames) will be displayed.
- Limitation of Liability & Damages
Waiver of Non-Economic Damages: To the maximum extent permitted by Texas law, Haslet Poop Scoop LLC is not liable for “non-economic” damages, including emotional distress, loss of companionship, or pain and suffering resulting from the loss or injury of a pet.
Liability Cap: IN NO EVENT SHALL THE COMPANY’S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
- Indemnification
The Customer agrees to indemnify and hold harmless Haslet Poop Scoop LLC and its employees from all claims, damages, and medical expenses arising from:
- The Customer’s breach of this Agreement.
- Injuries caused by the Customer’s pets to our technicians or equipment.
- Electronic Communications
By becoming a customer, you expressly consent to receive transactional emails and text messages (SMS) regarding your service, billing, and route updates. Standard messaging rates may apply.
- Changes to Terms
Haslet Poop Scoop LLC reserves the right to update these Terms & Conditions or pricing at any time. We will provide 30 days’ notice for any price changes. Continued use of the service constitutes acceptance of the updated terms.
- Miscellaneous
- Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Assignment: The Company reserves the right to assign or transfer this Agreement and its rights hereunder to a third party (e.g., in the event of a sale of the business) without prior notice.
- Non-Solicitation: Customer agrees not to solicit for hire any employee of Haslet Poop Scoop LLC for private services outside the scope of this Agreement
- Governing Law & Venue
This Agreement is governed by the laws of the State of Texas. Any legal suit, action, or proceeding arising out of this Agreement shall be instituted exclusively in the federal or state courts located in Tarrant County, Texas.
